ACA Subsidy Court Cases

Dear Arise Health Plan customer,

You may have seen news today about two conflicting federal court decisions regarding the legality of federal subsidies for low- and middle-income people who bought health insurance through the Federally Facilitated Marketplace (FFM), or Exchange, in certain states, including Wisconsin.

Arise Health Plan wants to assure you that there is no cause for concern about your current policy. The Obama administration said today that policyholders will continue to receive financial aid for their premiums as it seeks review of one of the rulings. White House spokesman Josh Earnest said the decision has "no practical impact" on tax credits as the case works its way through further appeals.

In the first case (Halbig v. Burwell), a panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled, 2-1, that the Affordable Care Act allows subsidies only for insurance purchases made through state-run Exchanges, not the federal Exchange.

In the second case (King v. Burwell),  a three-judge panel of the U.S. Court of Appeals for the Fourth Circuit unanimously ruled in favor of the government on the same issue, thus upholding the subsidies.

Further legal review will continue, so nothing will change for now if you currently receive a subsidy. Arise Health Plan remains focused on ensuring stability, affordability, and accessibility for our customers. We are committed to customer care.
